  1. LICENSE AGREEMENT

  3. Please read this License Agreement below before installing Super Drop List Software.
  4.  
  5. This License Agreement is a legal agreement between you and Andrew J. McGee
  6. for the software products, which includes the computer
  7. software, online documentation and associated media.
  8.  
  9. The license grants you the a limited, nonexclusive, royalty-free right to use
  10. the software with the following conditions: your application software product
  11. (1) is distributed in compiled form;
  12. (2) in no way competes, commercially or otherwise, with this software;
  13. (3) does not distribute the source code or part thereof in any form.
  14.  
  15. By installing, copying, or otherwise using the software, you agree to be bound
  16. by the terms of this License Agreement.  This software is licensed as a single
  17. product.  Its component parts may not be separated for use by more than one
  18. user.
  19.  
  20. COPYRIGHT NOTICE
  21.  
  22. This software is protected by copyright laws and international copyright
  23. treaties, as well as other intellectual property laws and treaties. The
  24. software is licensed, not sold.  The software consists of product
  25. documentation, sample applications, technical information and development
  26. tools.
  27.  
  28. Treat the software like any other copyrighted material except that you are
  29. authorised to either:
  30. (1) make one copy of the software solely for backup purposes, or
  31. (2) install the software on a single computer provided you keep the original
  32.     solely for backup purposes. You may not copy the printed materials which
  33.     accompany the software.
  34.  
  35. PRERELEASE CODE
  36.  
  37. Certain portions of the software may be identified as prerelease code. Such
  38. code is not considered to be at the level of performance and compatibility of
  39. the final, commercially available product offering. Such code may not operate
  40. correctly and may be substantially modified prior to first commercial shipment.
  41.  
  42. Andrew J. McGee is not obligated to make this or any later version of the prerelease
  43. code commercially available. The grant of license to use prerelease code
  44. expires upon availability of a commercial release of the prerelease code from
  45. Andrew J. McGee.
  46.  
  47. TERMINATION
  48.  
  49. Without prejudice to any other rights, Andrew J. McGee may terminate this agreement if
  50. you fail to comply with the terms and conditions laid out here.  In such event,
  51. you must destroy all copies of the software and all of its component parts.
  52.  
  53. DISTRIBUTION
  54.  
  55. Andrew J. McGee grants to you a limited, nonexclusive, royalty-free right to reproduce
  56. and distribute those files required for run-time execution of compiled
  57. applications in conjunction with and as a part of your application software
  58. product that is created using Borland Delphi, provided that:
  59. (1) you include a valid copyright notice in your software product;
  60. (2) you do not charge separately for the runtime files;
  61. (3) you do not modify the runtime files; and (4) you agree to indemnify,
  62.     Andrew J. McGee from any claims or lawsuits, including attorneyÆs fees, that arise
  63.     or result from the use or distribution of your application software
  64.     product.
  65.  
  66. Andrew J. McGee grants to you a nonexclusive, royalty-free right to use and modify the
  67. source code version of, and to reproduce and distribute the object code version
  68. of, the sample code, icons, cursors and bitmaps provided.
  69.  
  70. WARRANTIES
  71.  
  72. This software product is provided "as is" without warranty of any kind.  To the
  73. maximum extent permitted by applicable law, Andrew J. McGee disclaims all warranties,
  74. either express or implied, including but not limited to, fitness for a
  75. particular purpose.  Andrew J. McGee's entire liability and your exclusive remedy
  76. shall not exceed the price paid for the software.
